TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of the Nexo firmware and companion applications (together, the "Software") published by Apiwish Anutravanichkul ("we", "us"). By downloading, installing or using the Software you agree to these Terms. If you do not agree, do not use the Software.

1. License

The Software is free and open-source software licensed under the GNU Affero General Public License, version 3 or later (AGPL-3.0-or-later). Your rights to use, study, modify and redistribute the Software are granted by that license. Where these Terms conflict with the AGPL, the AGPL prevails for the licensed code.

2. Hardware and flashing

Nexo is designed to run on the M5Stack Cardputer (ESP32-S3). Installing firmware involves writing to your device's flash memory. Flashing is done at your own risk and may, if interrupted or misconfigured, render the device temporarily unusable until it is re-flashed. You are responsible for backing up your device and data.

3. Your content

You retain all rights to the notes, homework, music and other content you store on the device or in the app. The Software stores this content locally on your hardware; we do not host or access it.

4. Acceptable use

You agree not to use the Software to violate any law, to infringe the rights of others, or to upload content you do not have the right to use. You are solely responsible for the content you add and for complying with any copyright rules that apply to it.

5. Updates

The companion app can check for and install updates from the project's GitHub Releases page. Updates are optional and may change features. Automatic update checks can be turned off in the app.

6. No warranty

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE, INCLUDING ANY LOSS OF DATA OR DAMAGE TO HARDWARE.

8. Third-party components

The Software includes third-party open-source components and fonts (each under its own license). See the repository for details.

9. Changes

We may update these Terms from time to time. Continued use of the Software after changes take effect constitutes acceptance of the revised Terms.
